My email question to her was if she could explain to me the sentence in the report that concluded management had not adequately addressed several conflicts between employees A & B. I understand that was an unofficial report, not based on sworn testimony, that was not bound and tabbed like a full investigation might be. However, all investigations of that type, even if written for and intended for issuance soleley between managers, are subject to dissemination through FOIA and the EEO process. In this case, the complainant has a copy of that very report and I'm reading from their file. That's correct, they have it. In fact, normally these types of investigations result in or intertwine with eeo complaints, and the reports almost always go to the complainant. Yes. It's true. Yes, they really do.
So the problem I'm having is that even after interviewing the managers discussed, and reviewing all the interview notes, is that I cannot find support for that sentence. I don't know if there are other reports that I missed, if the reports themselves are incomplete, if Im simply not understanding the material, or if perhaps the choice of words did not best reflect the findings of the investigator - but since I am preparing for hearing and this report makes it necessary for me to call this investigator to testify in the hearing, I thought it would be best if we had a discussion so I had some idea of what her testimony was likely to be regarding these events prior the hearing.
