This is a boring story about my evidence class last night.

Background:
Ages ago a classmate passed along information which saved me in Const. law, without knowing it. He is friends with or a member of a tightly-knit conservative group we jokingly call "The republican mafia." He casually mentioned how Lund always asks you to describe your favorite majority opinion and why, and dissent and why. I had no idea, and based on that offhand comment I researched and prepared those answers. The questions were on the exam, and knowing this saved my ass.

Recently this same fellow detailed how another professor tests and notes some key points that I know to look at going forward in his class next term. He's a nice guy who just became a Daddy and is quick to note that it's not really worth the effort for A's in law school as the effort to grade function is logarithmic in nature. I presented to the evidence class a while ago, nailed it and made it look effortless, and he complimented me. Unfortunately, he did so in the bathroom and I'm kinda freaked about talking in b-rooms so I sort of said thanks and bolted. I can speak in public, but bathrooms?

Last night:
Same guy was asked to present on hearsay. This was a tough subject, and the judge was uncharacteristically nailing the guy pretty hard. He had obviously prepared, but was having a tough time fielding the questions in front of the class. It was brutal. The judge (professor is a judge), in the middle of the presentation, noted that the portion he was discussing came up in a case he asked the class to read in a mid-week email. He then asked if anyone was able to discuss the case (taking the heat off my friend).

Only one or two people and I raised our hands. I was called on, and to my shock was asked to come to the podium and present to the class. I grumbled, but know that in this 4cr class we get 25% of our grade from class participation. This guy, judge, who knows me by name, just asked me to present something that was dropped on us at the last minute and no one else volunteered. Great potential gain here!

I nailed it. I knew the case, I caught the subtle distinction on hearsay being admitted not for the truth of the assertion made, but for the basis of an officer's decision to search a room. I wasn't dressed for the occasion, but I pulled in my public speaking skills, panned the audience, spoke firmly and addressed the mic...it went well. After class several friends complimented me, and I quickly voiced my shock at being pulled in front of the class.

After class I sent an email to the guy noting that I didn't have any idea I'd get yanked like that, making sure that he didn't think I was grandstanding at his expense, possibly also inferring somewhat that I was trying to take heat off of him. He wrote back saying thanks and wishing he was better prepared.

I don't care about law school, but I keep score? It was fun to be challenged and do well.

I need to do more brain-teaser things or problem-solving or something... reading this made me actually MISS having class discussions. I feel like my brain hasn't been gettin' enough thinky time [at least, about things that're higher-level and don't concern myself in some way].

It was fun to be challenged and do well.

THAT. that is what I miss. that's super-cool that you pulled it off, though. :) yay! learning!
