Hearing is over and if I won again, it's for the same reasons - so here is a rare burst of FREE LEGAL ADVICE: 1) if you have no facts that support a legal theory that gets you money, don't waste your time trying to sue someone, 2) follow orders from courts and judges (helps if you read those orders fwiw), and 3) if you go to a hearing, be able to quickly access documents. Really, 2 and 3 are a large part of my job.
I kicked her ass up and down the street, but it was no accomplishment. The Judge cut her off and made her follow the format of a hearing, as opposed to the MSPB Judge who let her ramble, literally, for over 2 hours about alleged history predating the events in question (a history I eliminated with one document and question: Is that your signature on the document waiving all claims up to the date it was signed?).
But I wasn't that good. My 3, three, favorite questions from the hearing today were not my own - they were the Judge's. I went tit for tat between the eeo law and this person's story - disproving every ounce of their story and pointing out the events were all 100% legal. The Judge, on the other hand, pointed out the back page of a form in which the Complainant had signed waiver to allow the Agency (to assign her leave to cover OWCP leave if her claim was rejected, which it was). I spent all my time showing there was no discrimination, but didn't notice the back page of the multi-page form. There were a couple other events like that. I had a great script and it rocked the day quickly, but I feel like I was working with a big cumbersome net. I wonder if I could get to an outline format instead of putting down questions - would that speed me up?
How can I look for a job if I still suck this bad? There could not have been an easier case. Oh, I warned my witnesses they'd all wish they had done better - and here I am wallowing in the same, immune to my own advice.
I suppose "I want to have sex with your body" is a rude thing to say.
I hit the remains of main street in Garden City, KS, and it fits a pattern I've seen nationwide - one I love. 1) new strip malls draw all shoppers away from main street, 2) Main street "dies" as mom & pop stores belly up, 3) main street is revitalized by galleries, restaurants, cafe's, and arty crap. I love the new revitalized main streets across this country. Small towns? No problem.
So I'm sitting in one such place - Joe Dugan's coffee shoppe. It was empty when I walked in, now has maybe 10 people. A girl just walked by and gave a chocolate muffin to the two chunky latino girls sitting in front of me; her shirt says friends don't let friends drink starbucks (the only starbucks I saw in town is in target). And now those two girls just did shots of creamer. They're cute - was surprised they have un-accented english.
My new get rich slowly scheme is to travel the country to remaining mom & pop stores and teach them to convert to hip cafe's, so they remain authentic while surviving the transition while the community reaps the benefits of new main street faster. No idea how that idea gets money (the M&P Franchise, LLC?)
You know the new hip underclass? Latino. Have their own style, language, culture...yet immerse well. Can't wait for white kids from the suburbs to be latino-wannabes.
Thought I had more to say; if so it'll keep.

Date: 2014-08-06 12:18 am (UTC)Yes the J...no they're not...I'm supposed to tell them what to think and they rely on me. The fact they saw something I didn't is _actually_ a failure on my part.

Date: 2014-08-06 12:32 am (UTC)Thank you for correcting me on your role vis à vis judges.
I have family in Costa Rica! Maybe you and I are related! They be second-generation (depending how you count) Canuck white folks who holed up there to play on the beach, grow coffee and be the cousins we typically trash talk. I want to visit them and play on the beach and drink coffee.

Not adverse to coffee and beaches if you don't mind shade for cancer.
Re: bich plz
Date: 2014-08-06 07:12 pm (UTC)I don't mind shade! I like shade. I'm afraid of the sun, being cracker-to-the-roots (although when I get my stool I mean DNA sample back from the National Geographic I'm hoping there's some weird divergence, just so I can pretend I'm not such a whitey). Oh, this is exciting.

I've sworn off desensitizing liquids. Enjoy an extra one (or two) for me, thx.

Re: bitty bitch plz
Date: 2014-08-07 11:04 am (UTC)MY GOD YOU GAVE ME HOMEWORK
Why did you give me homework?
Bear - sounds cute; something tells me the description of the work is more interesting than the dissection of the work manually. Not my flavor but it sounds like a fascinating idea - particularly for the time.
Foul - terrible write-up in the beginning which is sad, because there was a great point they nearly ruined for garnering shock value. They went too angry too fast, where there was tons of material, they used the rape term interchangeably with exploitation, deception, and physical force. All are or can be rape, but there is also mutual using here (i.e. cleat chasers), lies that go both ways; the mixing of physical force with exploitation ruins the piece. I do, however, like the conclusions and display of mixed emotions about the author and his (lack of) actions vs. the general cultural artifacts it shows. The ending was neat - good conclusion.
*side note: I've noticed guys who treated people with respect are not overbearing parents of daughters, while raging douchebags are highly protective of their daughters, expecting people to be as horrible as they were.
And I have to start work and literally don't have the time to read the long article on autism - should I? I'm confused what you're doing sorry.
Re: bitty bitch plz
Date: 2014-08-07 03:21 pm (UTC)You don't have to read the autism thing. The homework is optional. It will not affect your grade in the class.
All I was doing/did was take the open tabs in my browser and copy the links and put them here. So you could read what I've been meaning to read but hadn't yet. I appreciate your read on "Foul" because I wouldn't mind getting editorial work for that publication. Now I can just quote you and pretend those were my thoughts and they'll be all like, "This bitch has a good point. Maybe we should hire her."
Thanks for playing. You got game!
