Your claim that you are protected under your EEO complaint seems to indicate a fundamental flaw in your understanding of the EEO complaint process. You are free from retaliation of any sort for filing an EEO complaint - but the filing of such a complaint does not 'exempt' you from the standards of conduct required of Federal Employees. You are held to the same standard as your peers, regardless of race, sex, religion, or other status. You are not allowed to engage in misconduct just because you have chosen to engage in the EEO complaint process available to you.
I cannot find that you were required to spit as a reaction to a cold. While a sickness produces discomfort, there is a wide range between having phlegm production and being forced to spit it out in public. While I am not a trained physician, I feel confident that it would be a rare prescription indeed that required spitting, and I see no evidence of such a prescription in your case. The claim that your desire to spit out phlegm kept you from being able to work your shift does not appear to be reasonable.
