Agreed - but at the present time we're losing Federally but winning some state battles. It's a sad state of affairs, but it's absolutely true that the law should not be construed on a state by state basis. We're just issue whores for the time-being.
The bigger concern is why push this issue now at all, when it can only hurt the non-Bush candidates. I think it's vitally important, but that it shouldn't be pressed during an election year. It's kept this long, it would keep another year.
